Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the OnScale iOS application and related websites (together, the “App”). By downloading, accessing, or using OnScale, you agree to these Terms. If you do not agree, do not use the App.

1.Agreement to These Terms
These Terms form a binding agreement between you and the operator of OnScale (“OnScale,” “we,” “us,” or “our”). They apply to the App, our support site, and any related services we provide.
If you use OnScale on behalf of an organization (for example, a team or gym), you represent that you have authority to bind that organization, and “you” includes that organization.
Please also read our Privacy Policy, which describes how we collect and use information. The Privacy Policy is incorporated into these Terms by reference.
2.About the App
OnScale is a mobile-first fitness tracking application designed for combat-sport athletes, including MMA, boxing, wrestling, Brazilian jiu-jitsu, and Muay Thai. The App lets you log and review information such as body weight and weigh-in goals, food and macros, hydration, workouts, and daily check-ins, and view progress on a dashboard.
Some features are available at no charge. Additional features (“Premium”) are offered as auto-renewing subscriptions sold through the Apple App Store. Apple processes payments, billing, and cancellations. We do not collect or store your payment card information in the App.
We may offer promo codes that provide complimentary Premium access. Redeeming a code typically requires a signed-in account. Codes may expire, be limited to one redemption per account, or be revoked if we reasonably believe they were obtained or used improperly.
We may change, add, or remove features, including which features are free or Premium, with reasonable notice when required. The App is provided for personal, non-commercial use unless we agree otherwise in writing.
3.Not Medical Advice
OnScale provides educational tracking tools only. The App is not a medical device, and nothing in the App is medical, nutritional, psychological, or sports-medicine advice. OnScale does not diagnose, treat, cure, or prevent any disease or condition.
Weight, nutrition, hydration, and training decisions are yours. You should consult a physician, registered dietitian, certified coach, or other qualified professional before starting a weight cut, changing your diet or hydration, or beginning a new training program — especially if you have a medical condition, take medication, are pregnant, or are returning from injury.
If you think you may have a medical emergency, call emergency services. Do not use OnScale for diagnosis or emergency care.
4.Weight Management & Competition Prep
Combat sports often involve making weight. OnScale can help you record weigh-in goals and related logs. It does not prescribe a cut, tell you how much to lose, or provide protocols for rapid weight reduction.
We do not offer, endorse, or include instructions for dehydration, sauna or sweat suits, extreme caloric restriction, diuretic or laxative use, or other unsafe cutting methods. Any such practices you undertake are outside the App’s purpose and are solely your responsibility.
You are responsible for complying with your sport’s rules, your team’s policies, and applicable law. Work with qualified coaches and clinicians for competition prep. OnScale does not guarantee that you will make weight, perform well, or avoid injury.
5.AI Features & Data Estimates
Certain Premium features use automated analysis to estimate nutrition from a meal or drink photo, or to look up packaged foods from a barcode. These results are estimates generated from models and third-party databases. They are not lab tests, not complete nutrient analyses, and not medical assessments.
You must review and, if needed, edit scan results before logging them. Serving sizes, ingredients, cooking methods, and database records can be wrong or incomplete. You are responsible for the values you save.
You can log food and drinks manually and search nutrition databases without using camera or AI scan features. Using those optional features may send content to third-party providers as described in the Privacy Policy.
We do not warrant that estimates will be accurate, complete, or suitable for any particular diet, sport, or health goal.
6.Eligibility
You must be at least 13 years old to use OnScale. If you are under 13, do not create an account or use the App.
If you are under 18 (or the age of majority in your jurisdiction), you may use OnScale only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.
You must have the legal capacity to enter into these Terms and must not be barred from using the App under applicable law.
7.Your Account
Some features require an account. You agree to provide accurate information (such as username and email) and to keep it up to date. You are responsible for maintaining the confidentiality of your password and for activity under your account.
Notify us promptly at support@onscale.app if you believe your account has been accessed without permission. We may suspend or close accounts that we reasonably believe are compromised, inactive, or used in violation of these Terms.
You may use OnScale without cloud sync in local-only mode when cloud services are not configured. Signing out does not delete your account or your data. To permanently delete your account and associated data, use Delete Account in Profile & Settings, as described in Section 14.
8.Acceptable Use
You agree to use OnScale only for lawful, personal tracking purposes. You will not:
- Interfere with, disrupt, or attempt to gain unauthorized access to the App, our systems, or other users’ accounts or data
- Reverse engineer, scrape, or copy the App except as allowed by law
- Upload malware, or content that is illegal, infringing, or that you do not have the right to use
- Misrepresent your identity, age, or affiliation
- Use the App to provide medical, dietary, or coaching services to others as if OnScale were a clinical tool
- Circumvent Premium, promo-code, or other access controls
- Use automated means to create accounts or access the App in a way that imposes an unreasonable load on our infrastructure
We may investigate suspected violations and take action we consider appropriate, including removing content, suspending access, or reporting conduct to authorities.
9.Intellectual Property
OnScale, including its name, logos, design, software, text, and graphics, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any ownership to you.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely in accordance with these Terms and Apple’s App Store terms.
You retain rights in the content you submit (such as logs and photos you choose to scan). You grant us a limited license to host, process, and display that content solely to operate, maintain, and improve the App and to provide support, as described in the Privacy Policy.
Nutrition reference data may come from third-party sources (including USDA FoodData Central and Open Food Facts) and remains subject to those sources’ terms and licenses.
10.Third-Party Services
The App may rely on third-party services, including:
- A cloud database provider for account authentication and optional cloud sync
- OpenAI, for automated analysis when you use meal or drink photo scan features
- USDA FoodData Central, for nutrition reference data
- Open Food Facts, for packaged-food and barcode lookups
- Apple, for App Store distribution, in-app purchases, and related platform services
Those providers have their own terms and privacy policies. We are not responsible for third-party services we do not control, including outages, data errors, or changes to their APIs. Your use of Apple’s services is also subject to Apple’s terms.
11.Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, secure, or error-free; that estimates, database matches, or dashboard calculations will be accurate; or that the App will meet your athletic, weight, or health goals. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
12.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONSCALE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50).
These limitations apply regardless of the legal theory (contract, tort, statute, or otherwise). Some jurisdictions do not allow certain limitations of liability. In those cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or for death or personal injury caused by negligence where such a limitation is prohibited.
13.Indemnification
You agree to indemnify, defend, and hold harmless OnScale and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the App; (b) your content; (c) your violation of these Terms or applicable law; or (d) your weight-management, nutrition, hydration, or training decisions, including any competition-prep practices.
We may, at our expense, assume exclusive defense of any matter subject to indemnification. You agree to cooperate with our defense of such claims.
14.Termination & Account Deletion
You may stop using OnScale at any time. To delete your account and associated data, go to Profile & Settings and choose Delete Account. Signing out does not delete your account or your data.
When you delete your account, we remove your cloud data (if cloud sync is enabled) and local data on that device, subject to limited copies we may retain as required by law, to complete transactions, or to resolve disputes, as described in the Privacy Policy.
We may suspend or terminate your access if you violate these Terms, if we discontinue the App, or if we are required to do so by law. If we discontinue the App, we will provide notice when reasonably practicable.
Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
15.Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows when the current version took effect. For material changes, we will provide notice in the App, on this site, or by email when reasonably practicable.
If you continue to use OnScale after the updated Terms take effect, you accept the changes. If you do not agree, stop using the App and delete your account.
16.Governing Law & Disputes
These Terms are governed by the laws of the United States and the laws of the state in which you reside, without regard to conflict-of-law rules that would apply another jurisdiction’s law.
If a dispute arises, you agree to first contact us at support@onscale.app and try to resolve it informally. If we cannot resolve it, you may pursue claims in a court of competent jurisdiction in your state of residence, unless applicable law requires otherwise.
Nothing in this section limits either party’s right to seek injunctive or other equitable relief for misuse of intellectual property or unauthorized access to the App.
